Brazil Justice has to stay, but he has to stay

Sean Goldman The 16th Federal Court of Rio de Janeiro decided that American David Goldman can live with his 9-year-old son during the week as long as the boy stays in Brazil. It was a victory of sorts, a decision by the Brazilian justice favoring American David Goldman, who is trying to take to the US his son, Sean Goldman, who was abducted by his own mother from the US to Brazil 5 years ago.

The mother, Bruna Bianchi, died while giving birth to a daughter last year, but the woman’s new husband, a powerful Brazilian lawyer, has been able to prevent Goldman from taking his son home.

The new decision by Rio’s Federal Justice also stipulates that Sean is to spend Sundays with his Brazilian stepfather, João Paulo Lins e Silva. The boy’s Brazilian family lawyer informed, however, that they are going to appeal the decision.

The same judge who issued this last ruling, Rafael Pereira Pinto, had determined earlier that the child be returned to his biological father to be taken to the US, but that order was overruled by the Brazilian Supreme Court, which also refused to deal with the case and sent it back to be decided by Rio’s Regional Federal Court (TRF).

Sean is being disputed in the courts by the stepfather, whose family the Lins e Silvas, is a very rich and influential family in Brazil. The previous ruling by judge Pereira Pinto had ordered that the boy be given to the father in 48 hours. The Supreme, however, on intervening has also noted that there is no doubt that “the minor needs to once again have contact with the father as soon as possible.”

Sérgio Tostes, the Lins e Silva’s lawyer, informed that he intends to appeal to the Rio’s TRF but recognized that the new determination is more suitable to Sean’s Brazilian family aspirations. They want to prevent the boy from suddenly moving to the United States, something that according to the attorney would be a violence against the boy’s own wishes.

Said Tostes: “The judge’s decision is totally extravagant and shows his acknowledgment that he made a mistake when he ordered a trip in less than 48 hours and compliance to an agreement in that country, out of his jurisdiction. For the family, this is something better, since he will not need to travel to the United States.”

Tostes handed out to the Justice, this week, a report prepared by a psychologist hired by Lins e Silva where it’s shown that Sean wishes to stay in Brazil. While the document has no juridical value Tostes believes that it might help his case and he encourages David Goldman to get his own psychologist to also hear the boy.

In a tape made by the psychologist and released by Lins e Silva, Sean calls Lins e Silva his father and insists that he wishes to stay in Brazil. The boy also complains that this biological father has skipped some visitations with him.

According to the psychologist Bianca Zacher, general secretary of the Brazilian Society of Juridical Psychology, heard by daily O Estado de S. Paulo, the child’s Brazilian family might be adding to the boy’s suffering by making him talk again. She says that is important that the boy be heard, but this should be done seldom and with much tact .

“The child,” she observes, “relives the traumas every time he exposes himself and needs to tell his story, which is suffering.” She also criticized the interview’s publication. “This child has already been overexposed,” Zacher argues.

Sean was born in New Jersey and lived there until the age of 4, when his mother, Bruna Bianchi, took him for what should have been a brief vacation to Brazil. Bruna, however, never went back to the US and ended up marrying Lins e Silva. Today, a age 9, the kid lives in Rio with the stepfather, the maternal grandmother and the little sister who was born last year.

Some friends of Goldman in the US believe that the father would have a hard time to leave everything in the United States to go live right now in Brazil to comply with the new ruling. They say that he is very busy in New Jersey where he makes a living organizing fishing boat rides for tourists.

The decision over the return of Sean could take a long time. Rio’s Regional Federal Court still hasn’t scheduled hearings to rule on the case.

    I am not sure why he speaks about abduction. According to international family law, the wife acted in accordance with rules: every spouse in international marriage has ultimate right to file for a divorce in his country, and the other spouse would have to come to the foreign court and prove his custody rights. The boy for sure had a Brazilian citizenship, and the fact of his residence in this country does NOT free the farther from the child support obligations. Also, this is a completely private situation and I don’t know why there is such a noise about it. If the farther filed for divorce ahead of his wife, her family would be now in the same miserable situation, trying to get custody of the boy in the US. In fact, there are so much more cases when a foreign wife gets divorced by abusive husbands in the US and separated from her kids only for no reasons, only because she is less wealthy in this country. We should better think of these mothers, who often have the US citizenship. This boy seems to be well taken care of without Hillary’s involvement. The boy has his step-sister in his step father’s family, and this would be a serious argument to leave him with the step-father even in the US. I actually know the case when a rich US father won the custody over the daughter from his lover girlfriend on the grounds that the girl should be raised with her step brothers and sisters. His girlfriend does not see her daughter for more than 2 years by now.

    The comfort of the child is what is supposed to be at stake, not the past, not the hurt feelings. I think they should share custody, but, obviously dual-country custody is impossible to enforce (because this exact situation would bounce back and forth.) The step-father has the situation right, though. DNA is not a determination of fatherhood. (I call biological implanters “gene-generators”. Or biological implanter works, too.) The child has a family in Brazil that cares and provides for him. I am not saying the gene-generator wouldn’t provide, but, that he is under no strain to care about the wholeness of the child’s life as seen by his demanding of the child to come to the United States. The child is already under strain because he lost his constant in his life, his mother. The child has two lives that should be blended. The “adults” need to recognize this and move on positively. What it appears is happening, with legal sanction, is a what amounts to a male pissing contest. There are no winners the way either of them want the outcome to be.

    I can’t believe the two previous posters (Kim, Miss)- you two obviously are NOT well informed about this case. First and foremost, David Goldman is NOT just “a biological implanter”!!! He and his wife were living in New Jersey, where the child WAS BORN and being RAISED and then one day, mom and son travelled for what Dad was lead to believe was a 2 week vacation trip. Once in Brazil that evil, selfish woman, Bruna, out of the blue, called and said she wasn’t returning home and wanted a divorce. Now if this isn’t kidnapping, I don’t know what is!!! David has as much right as Bruna to that child! How dare she decide for the two of them that the child should no longer be raised by his father?? What’s more, there is actual EVIDENCE, through audio tapes of conversations between Bruna and David which confirm that David was a very good, loving and supportive father, said so by Bruna’s very own words. Sorry folks, this case has nothing to do with foreign wives (as Miss suggests) getting screwed over by the “rich and powerful” American, blablabla… there is absolutely NO justification for taking that child away from his LOVING biological father, PERIOD. Yes, this American dad has as much right as any other to raise his own biological child. The Brazilian court system and the Brazilian stepfather DISGUST me. Bruna kidnapped that child and then the stepfather and his good connections with the Brazilian courts have helped aide Bruna in the kidnapping, which now has gone on for over 5 years. Now they have the audacity to claim that because the child has been there an extended period of time, that it’s in his best interest to stay????? They have the audacity to claim that the child wants to stay? No kidding! Shall we call it brainwashing? Furthermore, this whole B.S. story from the Silva’s that David hasn’t visited his son is such a joke- Dianne Sawyer and her crew (Dateline), who’s been following this case closely, went on a trip with David to visit his son and guess what? Step daddy never showed up with him! Let these ridiculous games stop once and for all and let this child be raised by HIS true FATHER- David Goldman!!!!

    This is an outrage! The stepfather has harassed David Goldman while he has been in Brazil, and for the court to say he can have visitation Mon-Sat. is ridiculous! How is this man who lives in the USA supposed to find employment in a country whose court system is stacked against him? Pay child support to a kidnapper? That’s rich! Sean Goldman should be returned to his father (not step father) IMMEDIATELY! Shame on Brazil and it’s courts and government! Crooked much?

    This is an outrage! Sean Goldman should be returned to his father immediately. Remember Elian Gonzales the CUBAN boy whose mother passed away in waters off Miami Beach Florida in an attempt to flee Fidel Castro Cuba. The biological father was reunited with his son after an international fiasco and much a due about nothing when Elian Gonzales, American family sighted the same ridiculous claims as the Bazillions are claming now.
    The damage has been done when the biological mother denied the child of his father in the most critical developing years of his life due to no natural cause or accidental cause of absence. The biological mother denied her then husband David Goldman his rights and violated the marriage vows. Vows that were empty words when spoken) she acted selfishly and exhibited irresponsible behavior. Her present husband should have seen this as a red flag no self-respecting educated attorney would encourage this kind of behavior of a prospective wife and mother.

    First and foremost, the first two posts related to this story sicken me. I would have to believe that people with that mindset either have no children of their own or are as hateful and spiteful as the mother in this story. I cannot even believe that the father in this story is being compared to some biological sperm donor. This father’s child was essentially kidnapped and taken from him. How dare anyone think that just because the witch remarried in another country that it automatically takes away his rights. The bottom line is that the mother was smart and slick and she knew exactly what she was doing the moment she got on that plane. The love for this child by the step father has absolutely no bearing on this case. I find it amusing that people believe that just because the son is being cared for and loved that the natural father should just casually walk away with a smile on his face. I realize that this situation is extremely difficult on this child, but just as polowna stated, the most important years for this child to bond with his natural father have been taken away, and that is not to the fault of the father. The step father needs to set aside his selfish pride and recognize that if he truly loves Sean, he would realize that this boy deserves to know and love his natural father.

    Honestly, this story shows how screw the Brazilian government and is proof that it can be bought. The excuses from the lame Brazilian government are ridiculous and it’s a shame but, not surprising from a third world country. I personally know of two guys who’s brazillian girlfriends left with their babies.

    I only hope that the same thing happens to a Brazilian citizen and I also hope the U.S. cut’s trades with this country.

    Sorry guys for my language but, I have nothing good to say about the Brazilian lame government. FUCK YOU BRAZIL!

    It’s wrong to alienate someones kid from their biological parents.

    And this Brazilian Step-father, I am glad your fucking bitch wife died. I hope your fucking daughter get’s kidnapped and maybe you learn how to become humble. What your doing is wrong and your day is coming.
